Exilium "General" Code of Conduct


**Under the new Exilium Hierarchy; Rules and enforcement of rules falls under the control of [Boss]Valthas Ravinos**
Section One

  1. Members in Exilium will treat each other in a respectful manner. As members of the this clan, we all share something in common. We are all exiles, outcasts, and shunned from other kingdoms and homelands. Whether we deserved this fate or not matters little. We are in this as a people and must stick together if we intend to survive this harsh world. All members must remember this and take care to treat each other accordingly. Mistreatment of each other on the forums, in guild chat, on Ventrilo, on IRC, or behind each others backs will not be tolerated. Punishment for this can be suspension, demotion, or even removal. Applicants who break this very basic rule will be removed from the guild without benefit of trial or appeal.

  2. Profanity and “over-the-top” flaming will not be tolerated. If any member feels they are being mistreated by a fellow member, that member is encouraged to take their case to [Boss]Valthas Ravinos for further investigation.

  3. Exilium urges it's members to use good judgment and intelligence when speaking about sensitive subjects, that may involve this guild or its members.

  4. Personal problems between two or more members should be resolved in private chat. If the involved members agree, then a Leader or Officer can be asked to help resolve the dispute. Excessive arguing in-game, in public forums, ventrilo, or IRC could result in removal from Exilium.

  5. If a member's conduct threatens to damage the reputation of the Clan or to spoil the enjoyment of other guildmates, that member could be exiled from Exilium (Irony?). Above all else, we serve the clan and what it stands for. All of our actions and words will benefit the clan. If a member is found to be speaking against his/her guildmates or the clan itself, severe consequences will soon follow.

  6. Members of Exilium will honor it's Leaders and officers. Inside this clan, our Boss/guild leader (Valthas Ravinos, and his officers will be respected and honored. Officers are not immune to the guild's rules. It is their responsibility to maintain the guild and see to day to day administration.

  7. Exilium will treat it's friends in a friendly manner 'most of the time'. We are a band of outcasts and brigands. We understand that betrayal and such will occur, but hopefully with good reason and only when wealth is to be gained. We should know that to betray a friend is a horrible thing to do..thus it should only be done when the rewards are simply too large to pass up. Betrayal of clanmates is strictly prohibited, however. Betraying a fellow Exilium member will, most likely, result in a strict punishment that could include your character's death and loss of all his valuables. Worst case scenario removal from our clan will also be included in the worst cases.

  8. Our enemies will not be afforded safe travel or passage. Enemies of our people should fear every noise they hear in the wilderness. Every shadow along the road should give them a start. For they never know when Exilium will strike and take revenge for years of hatred of our kind. We have nothing to lose..we are outcasts. A man with nothing to lose is a dangerous man.

  9. The leadership of Exilium does not condone the unprovoked harassment/griefing of other players. Exilium expects it's members to act like adults. As adults, we will have to make decisions as to what is acceptable and what crosses the line into harassment. We expect our members to use good judgment in this regard, and poor judgment will have its consequences. Exilium will do what it must to protect and preserve it's reputation in the DFO community. We may be brigands and thieves, but it only goes as far as the game. You are to treat everyone, guild member or enemy, with the basic human rights they deserve. Respect everyone..kill them and take their treasures..but respect them nonetheless. Fail to follow this basic rule and you will be removed from Exilium.

  10. Any member of Exilium found to be speaking to other clans or Kingdoms, enemy or friend, about Exilium matters is subject to consequences associated with treasonous behavior. This includes speaking to guilds regarding other members of Exilium.

  11. Any member questioning the ruling of Exilium's leaders or officers, publicly, is subject to consequences associated with treasonous behavior. If you feel a leader or officer has made a bad decision, please question them via pms, tells, email, or a private ventrilo session. Exilium does not condone it's leadership being questioned in public forums. We want to hear our members' opinions and we want their advice, but we prefer it given in a manner that does not cause members to lose morale or trust in their leadership. Questioning decisions publicly only leads to argument and morale loss.


Consequences of Failing to Adhere to the "General" Code of Conduct


Section two
  1. Issues of disrespecting members of Exilium will be handled promptly by the Boss or his/her's Officers. Punishments for disrespecting members of the clan can vary from simple warnings, demotion to trial status, to permanent banishment from the guild. This variance of punishment depends entirely on the severity of the disrespect. Full banishment and/or demotion can only be done if a trial is held giving the accused a chance to defend themselves.

  2. Issues of disrespecting leaders and officers of Exilium will be handled promptly by the Clan boss or his officers. The offending member(s) will be suspended from Exilium's forums and ventrilo, temporarily, until a trial can be held to prove the accused's innocence or guilt. Punishments for disrespecting leaders and officers of Exilium will usually include removal from the clan and possibly banishment if proven guilty.

  3. Issues involving disrespecting members or leaders of allied Clans or Kingdoms of Exilium will be up to the Boss and his/her officers. More likely then not, we will simply hand you over to them and let them do with you as they please. If you refuse to cooperate with your punishment, you'll be removed from Exilium. Trials are not needed for this rule. It is up to the Boss and his/her council to decide if guilt is present. If it is, the guilty person is to be handed over to the ally whom was wronged for punishment. If the ally pushes for their removal and enough evidence is present, then the removal may take place without a trial as allies are involved and their rules may differ from ours. However, the Boss and head of diplomacy are the final arbiter of this punishment. If they wish to risk our diplomatic relations with the wronged clan/guild to save the accused's membership, this is perfectly fine.

  4. Any member caught in harassment of other players in Darkfall Online, regardless of whether the player was enemy or friend, will be suspended from Exilium's forums and ventrilo, temporarily, until a suitable punishment can be named by the Boss and his/her Officers. Punishment for harassing other players in Darkfall Online will vary depending on the severity of the harassment.a).Certain exceptions to the above rule may be made if you, as the harasser, were ordered to execute said harassment by your Boss, your military commander or one of their officers officers.b).People whom appear on the Kill on sight list for being banned from this community may be dealt with in any fashion. Members will not be held accountable for their actions against such despicable people whom were banned from this community.

  5. All Treasonous behavior will result in immediate suspension of the member suspected. Any member suspected of treasonous behavior will be given only 24 hours to show for trial, as opposed to the normal 48 hours for lesser offenses. Punishment for treasonous members will always be full banishment from Exilium.


Activity Requirements - Pre-Game (Expires February 25th, 2009 unless unable to login to game)


Section three
  1. As a pre-game guild, we require our members to be active on the forums.a). There is no set formula for this rule. Leadership will regularly checked member's activity by checking their user account and checking their last login. Leadership will also check their posts and their contribution to forum activity.b). This is done to help maintain an active community pre-game. Leadership feels that an active pre-game community promotes recruitment, comradeship, and happier members.

  2. Members who fail to contribute to the pre-game community via posts or visiting the forums will be let go (removed from the guild). Members removed, as always, may reapply in 30 days. Trials are not required to remove members for inactivity.

  3. Ventrilo activity is not required but acts as a huge bonus to a member's activity. It is possible for a member to be active in ventrilo and barely active on the forums and pass our activity requirements.

  4. A general rule of thumb is a member who logs into the forums once every few days and makes a few posts now and then should be ok. It is also very important that when emails are sent out announcing big posts (like officer elections and threads that require members' attention) that members visit them quickly. Leadership will tend to run activity checks within 24 hours of sending these emails.

  5. Pre-Game phase for Exilium is officially over as the game is released. However, there are many people still not able to login or purchase the game due to lack of availability by the maker of the game. These members will remain in Pre-game phase and are accountable for these rules.

Activity Requirements - Release and beyond(Currently in Effect)



Section four

  1. Activity requirements once the game is released are created so casual players can keep their membership.

  2. Members who do not log into the game within 10 days will be removed from the guild due to inactivity. Leadership will assume this person is no longer playing. Members removed due to inactivity may reapply in 30 days.a). Members logging in for a few minutes every 10 days to avoid this rule will not get away with it. Leadership will notice this trend and remove them anyways.b). With the current state of Darkfall Online, it is possible that someone could not login for 10 days and still be active due to insanely long queue times and a buggy login server. These folks are "Required" to inform leadership they cannot login in order to get exception from this rule. If they fail to communicate with Leadership and do not login within 10 days, they will be removed regardless. If they inform leadership of their difficulties logging in, they can and will be put into the pre-game phase and the above section of rules (Section 3) will apply to them.

  3. If a member must leave town or take a leave of absence from the game for more then 10 days, he/she may send a private message to Valthas or email him at valthas@exilium-clan.com letting him know they will be gone for vacation, real life, etc. This member will then become immune to activity requirements if the time gone does not exceed 30 days. Those going over seas for military tours or beginning military training may be immune from inactivity requirements for up to one year if they inform leadership.

  4. Officers and elected officials within Exilium must log into game and perform their duties. Any officers or elected officials who do not login a minimum of 20 hours a week will be dismissed from that position. If it is a elected position, they will be dismissed and a new nomination process started.

Raid and PvE Code of Conduct


Section five

  1. Any member of Exilium whom complains about loot distribution in chat, public forums, IRC, or ventrilo is subject to disciplinary action up to removal from the group/raid and suspension from further group/raid activities. The period of such a suspension will vary based upon the nature of the offense. The ruling of the Boss or his/her officers, as it pertains to treasure distribution, is final in all Clan group or Raid environments.

  2. Any member who purposely attempts to deceive his fellow guild mates or leaders in a group setting, PvP group setting, or any group setting for PvE for the sole purpose of getting treasure for himself and withholding it from the clan will be removed from the group, pvp group, or PvE group immediately by the group leader. Such offenses will be sent to the Boss or his/her officers. Punishment for this underhanded behavior can vary from warning, to demotion, to full removal or permanent banning from the guild. Demotions to trial member status, removal from the guild, or permanent banning must be preceded by a trial where the accused may defend themselves.

  3. Any member of Exilium caught taking treasure that is not theirs but belongs to someone not in Exilium or allied to Exilium will be rewarded. :)

  4. Any member who disregards, either purposefully or without intent, the commands issued by group leaders, officers, or the Boss in a raid/clan event environment is subject to removal from said event and a suspension from all PvE/PvP events. The length of such a suspension will vary depending on the severity of the offense. A trial is not required to hand out this punishment. This punishment may be handed out by any officer, but may be overruled by the Raid Leader or Boss.


Military and PvP Code of Conduct



Section six

  1. Any member who disregards the orders of their commander or group leader in a guild PvP environment is subject to removal from the group and suspension from further guild PvP events. The length of such a suspension will vary depending on the severity of the offense. A trial is not required to hand out this punishment. This punishment may be handed out by any officer, but may be overruled by the PvP Leader or Boss.

  2. Any member of Exilium who seeks to PvP on their own (solo) is urged to remember who they represent and what our clan goals are. We urge our members to go out and plunder, steal from the rich, and raid the kingdoms of rich clans. But we also want to make sure our members keep track of who we are friendly with or who we have formally signed an agreement with not to rob/kill. Failure to adhere to our agreements could result in severe punishments. Members who disregard this rule and/or disobey it will be given a warning, a demotion to trial status, or full removal from the guild depending on the severity of the disregard of the rule. If the member is demoted to trial status, removed, or banned they must be given a trial to defend themselves.


Rights of Members and Applicants of Exilium



Section seven
  1. Full members of Exilium, cannot be removed from the clan without right of trial. Each member, depending on the severity of their actions, is given a time period to schedule a trial before the Leaders and Officers of Exilium. Every Full member is given this option as a inherent and innate right of membership. In this trial, the member is given ample opportunity to explain and defend their actions. After the trial, the Boss and his/her officers will decide the offending member's punishment.

    a). Only full members may request a trial. Trial members and applicant members do not have the right to trial.

    b). The member has the right to waive right to trial. They can decide to not show up for the trial or simply decline the trial. Failure to set a trial date in the time allocated to them or the waiving of right to trial is considered an admission of guilt.

    c). The process for trials will be listed in the last section

  2. Applicants are not full members of Exilium. They are in a trial phase or applicant stage. As such, they do not have the right to trial. They may be removed by any officer at will without due cause. This also applies to trial members (Drifters).

  3. The Boss of Exilium may suspend any member of the clan for up to two days from Ventrilo and the forums. Each suspension must be followed with a detailed explanation for the suspension, emailed directly to the suspended member, within 2 hours of the suspension becoming active. These details must also be given to the membership via a forum post. The post is to be LOCKED to prevent arguments. Members always have the right to know why their fellow brothers/sisters are suspended. If the suspended member is found innocent at trial, the topic created to inform membership is to be deleted. If he/she is found guilty, the topic stays forever until old enough to be moved to the archives.a). In most cases of a member's failure to adhere to any rules mentioned in this document, a suspension will follow, except in the cases of warnings. If a member is being suspended for their failure to adhere to any of the rules in this document, the offending member is given a certain amount of time to ask for a trial over the incident. Most of the time, the limit is 48 hours, to request a trial.

    b).A suspension may only last longer then 2 days IF a trial was scheduled and the member declares they cannot make the trial within 48 hours. At this time, the leadership may extend the suspension until the accused is able to attend their trial. The suspension may only be extended up to 14 days. If the accused cannot attend their trial within the 14 days, they will be considered guilty of the crime and sentenced appropriately without the right to defend themselves in trial.

  4. Officers may be removed from their officership by the Boss without vote or permission. The Leader can remove and replace the Officers at will. Exception to this rule is voted in Council Members. They may only be removed by a majority vote of the current Council. If they are removed, a new election must be held unless they were removed within 14 days in which case the runner up in the election takes the position.

Diplomacy and PvP Code of Conduct


Section eight

  1. Our Diplomacy list is published in the Clan Relations forum. Applicants do not have access to this forum so they must wait until their application is approved before seeing our diplomacy list. An applicant should ask a member or an officer if they have questions about our diplomacy.

  2. All Diplomatic matters and pleas should be brought to the Boss or Diplomacy officer.

  3. Above all things, every player in Darkfall Online is to be treated respectfully. This includes enemy guilds. Just because we may murder them in game and steal from them, does not mean there isn't a person behind that character. Treat them with respect. Kill them, sure...but do not rub it in, talk trash, or get into petty arguments over your kills. If you win, loot them and move on. Do not stick around and harass. If you lose, lose honorably and come back and get your revenge. Be a good sport above all.

  4. Under no circumstances are Exilium members allowed to negotiate treaties or speak on behalf of this clan in diplomacy. Any member caught running their mouths and attempting to speak for Exilium will be suspended and put on trial for removal. If they are a Applicant, they will be removed without benefit of trial or appeal.
Role-Play Code of Conduct


Section nine

  1. Members of Exilium who wish to participate in role-play activities will not be made fun of, discriminated against, or treated any differently then other members. Members of Exilium who mistreat role-players will be suspended from Exilium immediately and offered a trial. The most likely punishment, if found guilty, is removal from the guild.

  2. Members of Exilium will not participate in sexual themed role-play, cyber sex, or any other drama inducing type of story telling on Exilium property (forums, ventrilo, guildchat). The punishment for doing such will be a warning at first. After a warning is issued, if it occurs again, the offending member(s) will be suspended and put on trial for removal from the guild.

    a). Unacceptable types of role-play include cyber sex, sexually themed stories, sexually themed Private Messages, sexually themed ventrilo conversations acted out in character. This type of behavior is not acceptable in Exilium.

    b). In our past chapters, we've seen a long list of problems occur from romantic relationships started between people in the community. Though we will not hinder such relationships and most certainly don't have a problem with them, we know that a majority of them start out via role-play and romantic in-character relationships. These relationships, 100% of the time, lead to one of the two parties taking it beyond their role-play and beginning to take it much too serious. This always leads to heart break and drama that the leadership has to clean up. This rule is an attempt to prevent it from occurring or at least cut down on it. The above rule will be heavily enforced without remorse or regret.

    c). If you wish to engage in cyber sex, in character romantic relationships, etc please do so away from Exilium. Conduct such stories, character exchanges, and so forth on another forum, via instant messenger, or email. As long as it's not being done on Exilium's forums, ventrilo, guildchat, or private message system - we will not hold you accountable.

Trials, suspensions, and warnings
*NEW SECTION*


Section ten
    ***The following is the "correct" chain of events in the event of the code of conduct being violated:***

    First Offense: If it is a basic breaking of the code of conduct, the offending member will be given a warning. Warnings are given by sending a pm AND email (BOTH). Additionally, the member MUST be sat down in ventrilo and verbally warned, in the officer channels, by the Boss or one of his/her officers. Lastly, the warning must be recorded via a warning log held in the Officer forums.

    a).A member may request a record of their warnings at anytime. They are to only be shown their warnings. A member's warning record is private except to the Boss and his/her officers unless requested by the specific member.

    a). Members being warned does not have to be reported to the membership of Exilium, though it can be. The leadership is encouraged to report warnings to those whom may have been wronged by the offending member's code of conduct violation(s).

    b). Members who commit treasonous violations (if it's treasonous, it will be listed as such in the rule itself) should jump right to 2nd Offense at all times. Each treasonous violation counts as an offense. For instance, if a member commits two treasonous violations in one day, he/she will be on the 3rd offense. Depending on the severity of the treason(s), the offending member could earn a ride straight to the 4th offense. For example; stealing a lot of resources from the guild could result in going straight to the 4th offense as that person violated Rule 1- Section 1, Rule 5-Section 1, and Rule 2-Section 5. This is one example of how one act can break several rules. In this example, the offending member would skip straight to the 4th Offense. At the end of the day, it is up to the jury during a trial to determine the severity of the crime(s) committed and which offense they may or may not receive.

    2nd Offense: If the offending member has received a warning for this type of behavior before (Ie: they broke the same rule they've been warned for), they are to be suspended from the guild for 2 days. This suspension may last for up to 14 days, see Section 7, Rule 3 for more details. During this 2 day suspension, the member has the right to request a trial. If the member fails to request a trial within 2 days, he/she is considered guilty and they are handed a demotion to trial member status. If a trial is held and the offending member is found guilty, they are to be handed a demotion to trial status. They will need to re-earn their full membership. This punishment must be handed out, verbally, in ventrilo by the Boss or one of his/her officers. If the offending member does not login to ventrilo within 10 days to receive the punishment, then they are to be removed from the guild without trial due to inactivity.

    3rd Offense: Obviously if the offending member reaches the 3rd offense and is still in trial status from his/her's previous demotion at the 2nd offense, they can be removed from the guild without trial due to their Drifter status. However, if they've regained full membership and once again break a code of conduct rule (regardless of the rule) and it's been within 90 days of their demotion, they are to be suspended for 2 days. This suspension may last for up to 14 days, see Section 7, Rule 3 for more details. During this 2 day suspension, the member has the right to request a trial. If the member fails to request a trial within 2 days, he/she is considered guilty and they are removed from the guild. If a trial is held and the offending member is found guilty, they are to be removed from the guild. Members must be informed of the offending member's guilt and punishment. They are to be informed by a topic made in the Guild news forum. This topic is to include a post, made by an officer or the Boss, with in depth details of what rules were broken, a recording of the trial (if one was made), and why they were demoted. The topic will be locked and left there until it is old enough to be placed in Archives.

    4th Offense: As rare as it may be, some members may commit so many offenses in one day and/or commit them so severely that simple removal from the guild is not enough punishment. In instances like these, the member is suspended from the guild for 2 days. This suspension may last for up to 14 days, see Section 7, Rule 3 for more details .During this 2 day suspension, the member has the right to request a trial. If the member fails to request a trial within 2 days, he/she is considered guilty and they are permanently banned from the guild and placed on KOS. If a trial is held and the offending member is found guilty, they are permanently banned from the guild and placed on trial. All bannings must be properly announced to the membership with "IN DEPTH" details given. It is not required, but promoted, that a recording of the trial be presented to the membership as well. This is to be announced to the membership by transferring their application from "Accepted" to a special "Banned" sub forum. All replies to this application will be deleted and a simple reply with in depth details, what rules were broken, a recording of the trial (if one was made), and why they were banned will be made in the topic. The topic will then be closed and locked. The banned forum is open to all full members for viewing ONLY. This has always been the rule, dating back to Hand of Set. This process is a "REQUIREMENT".

Trials

  1. Every full member is given right to trial. It is their responsibility to request a trial during their suspension period (usually 2 days). However, leadership is urged to recommend trial and to remind the offending member of the trial process in their suspension email.

  2. Members do not have the right to attend trials unless they are jurors.

  3. If the member fears they will not receive a fair trial from the Boss and their elected council members and officers, they may request a trial by jury. This jury is chosen by taking the pool of active "FULL MEMBERS", subtracting the names who participated in the last two trials (including officers), and randomly picking remaining names. How the Boss randomly picks the names is up to him/her. But if he/she is found not to be using a system which accurately makes the selection random, the Boss could be found guilty of MANY code of conduct violations him/herself and could find him/herself standing before the Inner Sanctum pleading to keep their membership. The jury will contain 5 members. The Boss will still oversee the trial, but the jury will officially decide guilt or innocence.

  4. If a member cannot make their trial within 2 days, they may extend their suspension for up to 14 days while they are on vacation, out of town, etc and schedule a trial for when they return. However, if that member is caught online or it is found out they truly did not need the extension, more violations will be added to their list and they will be given 24 hours to attend a trial where they will be held accountable for their original crimes plus the new violations for lying to and wasting the time of Leadership.

  5. Once a trial is concluded, if the offending member is found innocent, all records of their crime (announcements made to the guild) will be deleted. Records are NOT kept of innocent members.

  6. Once a trial is concluded, if the offending member is found guilty, the punishment is handed out at the trial while the member is in the room. If the member is removed from the guild, their ventrilo account is deleted immediately after they are informed of the punishment and their ban on the forums (via the suspension) is lifted while they are demoted to visitor status. If a full ban is issued, their ventrilo account is deleted immediately after they are informed of the punishment and their ban on the forums (via the suspension) is made permanent.

  7. Once a trial is concluded, if the offending member is found guilty and feels he/she was not given a fair trial, they may appeal the decision.


**These rules are subject to change by the Leadership of Exilium. Any change to the rules above must be posted immediately and are not in effect until the membership is informed of said changes via email or PM.**
